1. Acceptance of Terms

By accessing the website at monroviaasphaltpaving.com (the "Site") or by engaging Monrovia Asphalt Paving ("we," "us," or "our") for any service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, do not use this Site or engage our services.

These terms apply to all visitors to the Site and to all customers who request or receive services from Monrovia Asphalt Paving.

2. Description of Services

Monrovia Asphalt Paving provides asphalt paving, sealcoating, crack sealing, parking lot striping, pothole repair, driveway paving, grading, drainage, and related services for residential and commercial properties in the greater Monrovia, CA area and surrounding communities.

All services are subject to a written project agreement or signed estimate. Work described on this Site is for general informational purposes only and does not constitute a binding offer. Services may be subject to material availability, scheduling constraints, and site conditions.

3. Estimates and Pricing

All estimates provided by Monrovia Asphalt Paving are based on information available at the time of the on-site assessment and are valid for 30 days from the date of issue unless otherwise stated in writing. Prices are subject to change if site conditions, material costs, or the scope of work changes after the estimate is issued.

An estimate does not constitute a contract. Work begins only upon execution of a written agreement and receipt of any required deposit, as specified in that agreement.

Additional charges may apply if hidden conditions are discovered during work (for example, a deteriorated subbase not visible during the initial assessment) that require additional materials or labor. We will notify you before proceeding with any work beyond the original scope.

4. Scheduling and Cancellation

Scheduling is confirmed in writing at the time of project agreement. We reserve the right to adjust scheduled dates due to weather conditions, material delays, or other factors outside our control. We will provide reasonable advance notice of any schedule changes.

Asphalt paving and sealcoating work requires dry conditions and appropriate temperatures. We may reschedule work without penalty if weather makes safe or quality work impossible.

If you need to cancel or reschedule a scheduled project, please notify us at least 48 hours in advance by calling (626) 263-8749 or emailing estimates@monroviaasphaltpaving.com. Cancellations made with less than 48 hours notice after materials have been ordered or crews have been committed may be subject to a fee as specified in your project agreement.

5. Payment Terms

Payment terms are stated in your written project agreement. Unless otherwise agreed in writing:

• A deposit may be required before work begins, as specified in the project agreement.
• Final payment is due upon completion of work.
• Accepted payment methods will be stated in your agreement.

Invoices not paid within the timeframe stated in your agreement may be subject to late fees. Monrovia Asphalt Paving reserves the right to suspend or withhold services for accounts with outstanding unpaid balances.

6. Customer Responsibilities

Before work begins, you agree to:

• Remove all vehicles, personal property, and obstructions from the work area.
• Identify and mark the locations of underground utilities, sprinkler lines, or other buried infrastructure not already marked by the utility company.
• Ensure the crew has safe and unobstructed access to the work site.
• Notify us of any HOA approvals, permits, or neighbor notifications required before work can begin.

Monrovia Asphalt Paving is not liable for damage to underground utilities, irrigation systems, or structures that were not identified or disclosed prior to the start of work.

7. Warranty

Any warranty provided by Monrovia Asphalt Paving is stated in your written project agreement. In the absence of a specific written warranty, work is provided as-is.

Warranties do not cover damage caused by: normal wear and tear; heavy vehicle traffic beyond the designed load capacity; tree root intrusion; soil settlement or subsidence not reasonably foreseeable at the time of installation; chemical spills; acts of nature; or customer failure to follow post-installation care instructions provided at project completion.

Asphalt is a flexible material that will develop surface cracks over time, particularly in Southern California's climate. Routine maintenance such as sealcoating and crack sealing is the customer's responsibility and is not covered under any project warranty.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Monrovia Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services or the use of this Site, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from services rendered shall not exceed the total amount you paid us for those services.

9. Warranty Disclaimers for Site Content

The information on this Site is provided for general informational purposes only. We make no warranties, express or implied, that the content is accurate, complete, or current. We reserve the right to update Site content at any time without notice. Nothing on this Site constitutes professional advice specific to your property or project.

10. Intellectual Property

All content on this Site - including text, images, logos, and page layouts - is the property of Monrovia Asphalt Paving or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.

11. Dispute Resolution

If a dispute cannot be resolved informally, the parties agree to attempt mediation in Monrovia, CA before pursuing litigation. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

12. Governing Law

These terms and any dispute arising out of your use of this Site or our services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the courts located in California for the resolution of any such disputes.

13. Modifications to These Terms
